Description

My client is a mature startup and provider of specialized cloud-based software for the energy industry, so it operates a business-to-business software-as-a-service suite (B2B SaaS). Customers are companies in the energy industry such as municipal utilities.

I have been supporting the SaaS provider since 2016 in contract matters and data protection law, among others:

  • Draft Cloud/SaaS agreements including controller processor agreements (data processing addendums - DPA).
  • Assistance in negotiating the Cloud/SaaS agreements with individual customers.
  • Drafting reseller agreements for third party resellers of the SaaS solution as a white-label product
  • Representation in litigation with outside counsel and settlement negotiations
